This Policy applies only to information collected through our Site. It does not apply to third-party websites or third-party mobile apps, or information collected by us offline or through other means.

Our Location

PMA is a United States corporation. The servers that support this Site may be located in the United States or other countries. Data protection laws vary from country to country; however, we will process your information in accordance with this Policy no matter where your data is stored. By using the Site, you freely and specifically give us your consent to export your personal information to the United States and to store and use it in the United States as specified in this Policy. Information We Collect

Information You Manually Provide. We may ask you directly for personal information, or you may provide it voluntarily through an online form. This information may include your name, email address, phone number, physical address, billing address, and product questions or preferences.

Information From Third-Parties. You may be able to register with, log on to, or enhance your profile on our Site by choosing to automatically populate the requested data fields with information you previously provided to a third-party social media platform (such as Facebook or X (formally Twitter). By doing this, you are asking the third-party platform to send us information, including personal information, from your profile on that platform.

Information Collected Automatically. We collect information automatically when you visit our Site. This information typically includes your IP address, the name of your operating system, the name and version of your browser, the date and time of your visit, and the pages you visit. The information we receive may depend on your browser or device settings.

Aggregated and De-Identified Data.  We may also collect, use and disclose aggregated and de-identified data such as statistical or demographic data for any purpose.  Aggregated and de-Identified data could be derived from your personal information but is not considered personal information under applicable law as this data will not directly or indirectly reveal your identity. However, if we combine or connect aggregated or de-identified data with your personal information so that it can directly or indirectly identify you, we treat the combined data as personal information which will be used in accordance with this Policy.

Online Chat Features.  We may partner with a trusted third-party vendor to provide you with chat features to better assist you.  When using the chat features, please only provide necessary information and do not provide sensitive information.  For recordkeeping, training, and quality assurance purposes, we or our third-party vendor may record and maintain a transcript of any communications in the chat.

Recording Use of the Site.  We partner with trusted third-party vendors to analyze performance and traffic of our Site.  This may include things like buttons you click, mouse movements and other behavior on the Site, date and time of access, pages visited, web beacons, and cookie or pixel tag information. Mobile Numbers and Short Message Service (known as SMS or text messaging)

You may have the opportunity to receive SMS or “text” messages, pre-recorded voice messages or auto-dialed phone calls from us, our affiliates and related entities as well as third parties.  Such messaging may be used to authenticate your identity or mobile device, as well as provide you informational updates about services or products you may have requested.  In providing your mobile device number or cell phone number to us, you knowingly consent to such communications from us or for us to use your cell phone number or mobile device number.  In providing your number, you represent that you have the authority to agree to receive text messages at the telephone number that you provide to us, or from which you sent the text message request to us.  You further acknowledge that: (a) no purchase is required to opt into this service; (b) you may opt out at any time by following the instructions provided in our communications to you; and (c) your receipt of text messages may result in separate charges from your mobile provider. 

Any such communications you receive from us will be administered in accordance with your preferences and this Policy.  SMS opt-in and Mobile Numbers collected for SMS purposes will not be shared with third parties and affiliates for marketing purposes.

How We Disclose or Share Your Information

With Third-Party Vendors

PMA discloses information collected through this Site to third-party vendors who act for us or on our behalf. For example, we may use third-party vendors to design and operate this Site, to conduct surveys, and to help us with our promotional efforts. These third-party vendors may need information about you to perform their functions.

With Other Users of this Site

You may be able to submit User-Generated Content on or through this Site. In this Policy, “User-Generated Content” or “UGC” refers to any content that you post using the social networking or product review tools we make available to you and that does not constitute “Feedback” (as that term is defined in our Terms of Use). Any personal information contained in UGC can be read, collected, or used by others. In addition, we may use UGC you submit for advertising campaigns and other promotions. We may or may not use your name in connection with such use, and we may or may not seek your consent before using the content for such purposes. Therefore, you should have no expectation of privacy with respect to UGC you submit on or through this Site.

With Third-Party Social Media Platforms

We may provide functionality on this Site that allows you to automatically post information about the actions you take on this Site to a third-party social media platform (such as Facebook or X [formally Twitter]). If you choose to take advantage of this functionality, people with access to your profile on the third-party platform may be able to see the actions you have taken – for example, the items you have purchased. Thus, you should have no expectation of privacy in those actions. Further, if you choose to link your profile on this Site with an account on a third-party social media platform, we may share the information in your profile with that third-party platform. If you log into our Site using your credentials from a social media platform or if that social media platform has delivered a “pixel” or similar tracking code to your device, that platform also may receive data about the pages, videos, or other content that you viewed on our Sites. With Our Distributors, Licensees and Others Affiliated

PMA may share the information collected through this Site with its affiliated, licensees and independent contractors (collectively “contractors”). Our contractors  may use the information in all the ways listed in this policy, provided that such use relates to products or services authorized by PMA. For example, if you request an appointment, we will need to share your information with a PMA contractor near you to schedule an appointment. Our contractors may also use your information for their own marketing purposes, provided such marketing relates to products or services authorized by PMA – they may not use your information to promote competing windows or doors or other, products or services not authorized by PMA.

With Business Partners

From time to time, we may share your information with selected third parties (other than our third-party vendors or contractors) for joint marketing purposes.

As Part of a Business Transfer

Your information may be transferred to successor organization if, for example, we transfer the ownership or operation of this Site to another organization or if we merge with another organization. If such a transfer occurs, the successor organization’s use of your information will still be subject to this Policy and the privacy preferences you have expressed to us.

To Comply with Laws and Protect Our Rights and the Rights of Others

Links to Other Websites, Devices, and Software

Our Site may contain links to other sites that are not operated by us. If you click on a third-party link, you will be directed to that third party’s site. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

If you are using certain Pella products, such as those featuring Pella’s Insynctive technology, these products can communicate directly or indirectly through third party devices and software (“Affiliate Devices”). Pella technology acts as a bridge between Pella products and Affiliate Devices. Through Pella Insynctive products, Affiliate Devices may collect certain personal information including product usage data, and general location-based information. These third parties may share information they collect about you with us, but we are not responsible for their data collection practices. We urge you to review their privacy policies to better understand their processing of your data. Data collected through our Site by third parties help us and our partners better understand how our consumers are using our products and how to improve our products.

Opting Out of Interest-Based Advertising

The online advertising industry provides a service through which you may opt-out of receiving targeted ads from certain data partners and other advertising partners that participate in self-regulatory programs. You can opt-out of targeted advertising from certain providers across computer and mobile device browsers by selecting “WebChoices” at https://youradchoices.com/control. To help control how participating entities use your information for “in-app” advertising on your mobile device, download and use the “App Choices” app from https://www.aboutads.info/consumers. Please note that by opting out, you will continue to see generic advertising that is not tailored to your specific interests and activities. To be clear, cookie-based opt-outs must be performed on each device and browser (e.g. Chrome, Firefox, MS Edge, Safari) that you wish to have opted-out. How We Protect Your Information

PMA takes reasonable technical, physical, and administrative precautions to provide a level of security appropriate to the sensitivity of the information we collect. Although we use reasonable measures to help protect your information against unauthorized use or disclosure, due to the inherent open nature of the Internet, we cannot ensure or warrant the security of any information provided online. Therefore, we cannot guarantee the security of information provided over the Internet or stored in our databases and will not be responsible for breaches of security beyond our reasonable control.

Your Rights Under State Law

California

• Shine the Light law.  Pursuant to California Civil Code Section 1798.83, we will not disclose or share your personal information with third parties for the purposes of third-party marketing to you without your prior consent. 
• Do Not Track Signals.  Other than as disclosed in this Policy, the Site does not operate any differently when it receives Do Not Track signals from your internet web browser.

Nevada

Your Consumer Rights

Some state laws in the United States provide consumers with additional rights with respect to their personal information (also known as “personal data”), as those terms are defined under those applicable state laws. Such state laws may include, but are not limited to, the Maryland Online Data Privacy Act, (collectively, the “U.S. State Privacy Laws”). Any personal information we collect is collected for the commercial purpose of effectively providing our services to you, as well as enabling you to learn more about, and benefit from, our services.  If you reside in a state that provides additional rights with respect to your personal information, you may exercise each of your rights as identified below, subject to our verification of your identity.

1. Access.  You have the right to request that we disclose certain information to you about our collection, use and disclosure of your personal information. 
2. Correction.  You have the right to request that we correct or rectify your personal information. 
3. Limit Use and Disclosure of Sensitive Personal Information.  You have the right to request that we limit the use of the sensitive personal information to that use which is necessary to perform our services.  We do not use your sensitive personal information in a manner that requires you to limit its use.  Therefore, there is no need for you to limit the use of your sensitive personal information.
4. Portability.  Upon request and when possible, we can provide you with copies of your personal information.  When such a request cannot be honored, we will advise you accordingly.
5. Deletion.  You have the right to request that we delete any of your personal information, subject to certain exceptions.
6. Third-Party Disclosures.  The right to request that we provide you with a list of parties to which we disclosed personal information.  If you live in Minnesota or Oregon, you may have the right to request a list of third parties to which we disclosed personal information. If you live in Delaware or Maryland, you may have the right to request a list of the categories of third parties to which we disclosed your personal information.  This Policy is intended to satisfy your right relating to the categories of third parties. 
7. Opt-out of the Profiling, Sale, and Sharing of Personal Information.  You have the right to request that we do not sell your personal information, share your personal information for targeted advertising, or use your personal information for profiling.  There is no need for you to opt out of the sale or sharing (targeted advertising) of your personal information to third parties as we do not sell or share (targeted advertising) your personal information.
8. Non-Discrimination.  If a consumer exercises his or her rights under applicable U.S. State Privacy Laws, we shall not discriminate against that data subject by denying our goods or services, charging different prices or rates to similarly situated consumers, providing a different level or quality of our goods or services, or taking any other adverse action. 
9. Exercising your rights.  If you are a consumer that has rights under applicable U.S. State Privacy Laws who chooses to exercise the rights listed above, you can submit your request to marketing@pellamidatlantic.com.

Only you, or someone legally authorized to act on your behalf, may make a request related to your personal information.  If an authorized agent makes a request on your behalf, we may require proof that you gave the agent permission to submit the request. 

Upon receiving your request, we will confirm receipt of your request by sending you an email confirming receipt.  To help protect your privacy and maintain security, we may take steps to verify your identity before granting you access to the personal information.  In some instances, such as a request to delete personal information, we may first separately confirm that you would like for us to in fact delete your personal information before acting on your request.

We will respond to your request within forty-five (45) days.  If we require more time, we will inform you of the reason and extension period in writing.  You may have the right to appeal our decision regarding your request.  If you would like to appeal our decision, please contact us using the contact information provided above.

In some cases our ability to uphold these rights for you may depend upon our obligations to process personal information for security, safety, fraud prevention reasons, compliance with regulatory or legal requirements, or because processing is necessary to deliver the services you have requested. Where this is the case, we will inform you of specific details in response to your request.

A Note About Children’s Privacy

You must be at least 18 years old to have our permission to use this Site. We do not knowingly collect, use or disclose personal information about visitors under 13 years of age.
